COACHING SERVICE TERMS AND POLICIES
A. COACHING AGREEMENT TERMS AND CONDITIONS
By purchasing individual (one-on-one) or group coaching services, including masterminds or any other group program which has a coaching component, from Conscious Millionaire Institute, LLC, (or it’s affiliates) you, “Client” hereinbelow, agree to the following terms, conditions, and policies, “Agreement” hereinbelow, to represent the full understanding between Client and Conscious Millionaire Institute, LLC, “CMI” hereinbelow. Purchase on Client’s part represents an understanding of these terms, conditions, and policies and makes Client a willing party to this Agreement.
The physical address and/or email address for notices to Client is that which is submitted with the purchase. The address for notice to CMI is 301 W Platt Street # 700, Tampa, FL, 33606, work phone is 813-839-1739, with a notice email contact of coaching@consciousmillionaire.com.
Should Client have a change in address, phone, or email, at any time during the course of this Agreement, Client shall inform CMI, in writing, immediately upon making any contact information change.
This agreement is entered into in the State of Florida and laws of Florida shall apply with the Courts of Florida having Jurisdiction. The purpose of this agreement is to cover the fundamental understandings between Client and CMI related to coaching services or programs as well as related services provided by CMI to Client.
The specific offering terms of Client’s program or product are those stated on the order form and/or offer (landing) page, shopping cart product description, or a website owned or operated by CMI.
If Client purchased coaching services or program with an ongoing renewable fee, such as monthly fee, or a multi-payment term, then payments are due and payable as indicated in the offer.
All Coaching programs are paid for in advance, typically monthly, by onetime payment, or by multiple payments for a specific priced term program. Failure to make timely payment, including the credit card on file not going through (failure) for a given charge, may result in termination of coaching services until payment for that time period is paid in full.

It is the CMI’s goal that you, the Client, is always pleased with the quality of your coaching and find your coaching services of high value. This is the reason we deliver them to you. Therefore, CMI provides an Unconditional 30 Day Full Money Back Guarantee through the first 30 Days of any individual or group coaching program.
If for any reason you are not completed happy with the results you obtained during your first 30 Days of a program, simply notify us by phone or email sent to coaching@consciousmillionaire.com of the reason you are dissatisfied along with a request for a full refund. You money will be refunded and your coaching program will be terminated.
TERMINATION AND REFUNDS (NOT 30 DAY GUARANTEE RELATED)
Refunds related to money back guarantees are provided as indicated hereinabove. All other termination and refund terms are as follows:
1. COACHING MONTH TO MONTH, NO SPECIFIC TERM: If there is no specific term for the coaching program, then Client may cancel by providing a thirty (30) day notice of termination at any time. Email 30 day notice of termination to coaching@consciousmillionaire.com. Client’s right to Bonuses, Products, Services, or other benefits not yet received by Client prior to termination shall be forfeited and are hereby rendered null and void upon Client’s termination.
2. COACHING WITH MINIMUM OR SPECIFIC TERM: If there is a minimum or specific term, such as three months, then after the 30 Day Money Back Guarantee period, Client may terminate at any time following the completion of the minimum or specific term of the coaching program. After that date, Client may cancel by providing a thirty (30) day notice of termination. Email 30 day notice of termination to coaching@consciousmillionaire.com. Client’s right to Bonuses, Products, Services, or other benefits not yet received by Client prior to termination shall be forfeited and are hereby rendered null and void upon Client’s termination.
CONDITIONS FOR CMI TO TERMINATE ANY TIME, WITH OR WITHOUT CAUSE
CMI may terminate any time if client, in CMI’s sole discretion, fails to act in a professional manner or does not adhere to company policies. If CMI terminates this agreement, then CMI shall refund any pre-paid monies in it’s possession on a pro-rated basis. Further, in the case that CMI terminates, then any Bonuses, Products, Services, or other Benefits that were specifically stated on order form to be provided to Client prior to the date of termination, shall be provided as agreed.
AUTOMATIC RENEWALS OF COACHING – WHEN APPLIES
For the convenience of both Client and CMI, all specific term individual coaching shall automatically renew on a month to month basis. Upon a month to month renewal, all coaching programs may be terminated at any time by a thirty (30) day notice of termination delivered as provided in these terms by either Client or CMI. All other terms and conditions as outlined herein continue to apply to coaching that is automatically renewed on a month to month basis.
CLIENT’S PROFESSIONAL, ETHICAL, LEGAL OBLIGATIONS
CMI is committed to high standards of professional and ethical behavior, as evidenced by our company values which include honest dealings and integrity. CMI is also committed to doing business in a lawful manner. The brand CMI represents creating profits by acting with integrity and doing the right thing. Therefore, if in the sole judgment of CMI, the Client’s business or personal behavior is unprofessional, unethical, potentially illegal, evidences a lack of business or financial honesty and integrity, if Client is criminally charged or is the subject of a civil lawsuit for alleged involvement in financial or business dishonesty, theft, or moral turpitude, then CMI reserves the right to immediately terminate the Coaching Agreement, with or without cause; in which case, CMI shall prorate any prepaid funds on hand and return the unused portion of these monies to Client within twenty (20) days of CMI terminating the Client Agreement, except in such case as law enforcement, legal authorities, or a court advises, demands, or requests otherwise, or CMI’s legal representatives advises CMI to retain the funds or turn them over to legal or court authorities. At CMI’s sole discretion, CMI may choose to return monies to Client either by check or refund of credit card.
ATTORNEY’S FEES AND COLLECTION FEES
Any check that is returned by bank as uncollectable will result in a $35.00 fee or 3% of the face value, whichever is greater, up to a maximum of $150.00. Any coaching and related fees that are past due for thirty (30) days or longer shall result in an interest rate applied to the outstanding balance of 1 1/2% per each month, or portion thereof, that fees remain past due.
COACHING POLICIES
All coaching policies which appear on any website, sales or landing page, or internet site owned, leased, or promulgated by CMI as well as any CMI materials provided to any given coaching client are incorporated herein by reference. Client agrees to abide by all CMI Coaching Policies. Coaching Policies may be found immediately following this Agreement.
CLIENT’S RECORDING OF INDIVIDUAL AND GROUP COACHING, EVENTS
Client agrees to NOT record or distribute recordings of individual or group calls with Coach or other group client members. Further, Client agrees to NOT record any events. Any recording is a violation of copyright law and may subject any person(s) who creates recordings as well as any person(s) who distribute to criminal and civil legal prosecution.
INDIVIDUAL COACHING SESSIONS MISSED AND CANCELLATION: The specific time of each call is agreed upon in advance at the convenience of the Client and CMI Coach. Client is allowed one (1) emergency cancellation per three (3) months of coaching, which can include a missed session which CMI will then reschedule at no charge. At all other times, Client must provide CMI Coach a minimum of 24 hours notice, by phone call/voice message or that session is forfeited by client. All Make up calls must be completed within thirty (30) days, such as for emergency cancellation.
INDIVIDUAL COACHING CALL PROCEDURE: Client shall call CMI Coach J V Crum III at 813-254-3905 (private coaching line) or such other number as CMI shall provide, on a session by session basis, for individual coaching calls. Client shall be responsible for all telephone charges to the phone number at which CMI Coach is located. For all non-coaching appointment calls, phone 813-839-1739. If you purchased a group coaching program, you will receive email notification of the appropriate line to call for teleclasses or link to utilize for webinars. Group coaching calls may be recorded by CMI and distributed to group members.
NATURE OF COACHING RELATIONSHIP: This is a business coaching relationship. The CMI Coach has a background that may include any of the following: Business Growth and Development, Strategic Planning, Success Plans, Accountability, Wealth Mindset, Goal Setting, Time Management, Corporate Vision and Business Models, Values Clarification, Leadership, Entrepreneurship Success, Sales Training, Marketing, and Neurolinguistic Programming. CLIENT AGREES AND UNDERSTANDS THIS AGREEMENT IS FOR BUSINESS COACHING. The services do NOT include therapy, psychological counseling, legal advising or representation, accounting, investing or financial advice, or any other licensed services; if Client desires any of these types of services, then Client is advised to seek such services from professionals licensed in these areas. Client further acknowledges that James V. Crum III is a licensed attorney and licensed real estate broker in both Florida and Colorado, that James V. Crum III is NOT providing legal or real estate services to Client; and, Client shall NOT interpret any coaching or other services as being legal or real estate services, advice, counseling, or other related professional licensed services.
CLIENT ASSUMES 100% RESPONSIBILITY FOR ALL OUTCOMES: It is the client’s full responsibility to make all final decisions and is solely responsible for all implementation and outcomes achieved, or not achieved. Because CMI and CMI Coach have no power to make a client’s final decision or to implement actions that the client takes, client agrees that CMI AND CMI Coach, and James V. Crum III, have no legal responsibility for the results that client obtains, or fails to obtain, or for the decisions or actions that client may, or may not take, which in any way relate to any services which CMI, CMI Coach, or CMI agent provides. Client agrees to hold harmless CMI, it’s officers, directors, stockholders, employees and agents from any legal responsibility, whatsoever, for the results that client achieves related to their coaching, consulting or other services provide by or through CMI. No representations are made as to the specific financial or other results that client shall achieve.
COPYRIGHTED MATERIALS
All materials provided to Client are copyrighted materials which are copyrighted as owned by JAMES VIVIEN CRUM, III AND/OR CONSCIOUS MILLIONAIRE INSTITUTE, LLC. Copying by any means whatsoever, distribution, or sale of any materials provided to Client is a violation of copyright laws. CMI may prosecute Client to the fullest extent of the law for said violations or copyright infringements.
TRADEMARKS
“Conscious Millionaire” and “Conscious World” are federally registered trademarked and may be registered trademarked in other countries or jurisdictions. Use of same is violation of federal and common law trademark laws. Anyone violating these laws may be subject to criminal and civil legal prosecution.
PUBLICITY RIGHTS – PUBLICITY AND MEDIA POLICIES

FULL AGREEMENT: This constitutes the full understanding between the parties. This agreement can only be modified by a writing that refers to this agreement and is signed by both parties by an authorized representative.
B. CLIENT COACHING POLICIES
1. Be 100% Committed: By deciding to begin a coaching relationship, you are making a commitment to yourself, to your life, and to your business. You are also making a commitment to your Coach to be 100% committed to achieving your results. Our coaching is results focused. Instead of making goals, you will create results you are fully committed to achieving. The coaching experience begins the moment you commit to your coaching program. We want you, to obtain a high return on your investment; the only way you can do this is by becoming 100% committed to giving your best and completing the actions you commit to in each coaching session. If there are any areas in which you are not excelling, blocks that are occurring, ways in which you are not feeling focused, please communicate these to J V Crum III or the coach you are utilizing with CMI.
2. Accountability: During each session, you, the Client, will develop one or more action steps to take before the next session. CMI asks you to commit to your action steps and your Coach will ask your permission to hold you accountable. You, the Client, choose the accountability standard you desire and this is the accountability your coach will utilize in reviewing your action steps from the prior coaching session.
3. Communicate Openly, Honestly and Straightforwardly with Us: CMI expects both Coach and Client to be open and honest with one another. This is the only way in which genuine, authentic communication can occur. It is also the only way to develop realistic expectations. Please be straightforward in providing feedback and in communicating your needs or expectations. If you, the Client, are not getting everything you are wanting from J V Crum III or any other coach with whom you are working, please communicate this so that CMI and your coach can make any necessary changes.
4. Keeping and Changing Appointment Times: Client agrees to call at the appointment time and to provide a minimum of twenty-four (24) hours notice by written email to coaching@consciousmillionaire.com and by phone call to CMI’s office # of any cancellation or request for rescheduling, excepting the unusual emergency that could occur. If Client does not provide a twenty-four (24) notice or request for rescheduling then Client agrees and understands that Client shall forfeit that coaching session. All scheduled coaching appointments will begin and end at the agreed times; therefore, if Client is late for a scheduled coaching time, then Client acknowledges and agrees that the coaching session will end as agreed and Client forfeits the time Client was late. The session time will not be extended because Client is late.
5. Payment of Fees on Time: Client agrees to pay all coaching and related fees on or before “due dates” for said payments. If a credit card that is on file with CMI has been cancelled or does not have enough credit available to pay the next payment to CMI, then Client agrees to notify CMI in writing by email to coaching@consciousmillionaire.com at least seventy-two (72) hours prior to due date and to provide CMI with an alternative credit card or arrange to mail a good funded check to CMI for the next payment. All payments for coaching are made in advance of services as is customary in the coaching profession. If any payments are late, coaching services may be suspended until the current payment is made in full.
6. Professional, Ethical, Legal Behavior: Coaching is a professional relationship and we expect that coaching clients will always conduct themselves in a professional, ethical, and legal manner. This includes supporting mutually respectful interactions and being polite. We have zero tolerance for abusive or derogatory language or behavior expressed toward any coach or person associated with CMI.
7. Completion of Coaching Programs: Client agrees to complete any program he or she begins. One of the primary reasons people fail to achieve the level of wealth and success they desire is from failure to follow through. Come to your coaching program fully committed to both achieving the results you want by completing your sessions.
